Divorce

If you are contemplating divorce, you will want someone who can execute a strategy that protects your rights from the onset.  In handling countless divorces, our attorneys have the expertise necessary to develop strategies and arrive at an equitable solution. First, you will need to know the significance of being the first party to file for divorce, and why you should remain in the marital home.  Contact our attorneys for a free phone consultation before you take action, and we can explain.

Property Settlement

Regardless of your income level or financial resources, our attorneys will strive to protect your interests in a division of property.  We would ensure that assets are properly evaluated (i.e., businesses, collectibles, inheritances, premarital property, etc.), and avoid costly litigation whenever possible to protect those assets.  Contact us for a free phone consultation.

Custody/Parenting Time/Visitation

Most importantly, it is essential to minimize any damaging parental conflict in disputes over the custody and parenting time of your children.  If you are the non-custodial parent, we can explain why it is important to have a specific schedule in place for visitation and what can be done if the custodial parent prevents you from exercising your parenting time.  Contact our attorneys for a free phone consultation.  They will guide you through the process with compassion and concern for your child’s best interests.

Child Support

Child support in Michigan is not based solely on a percentage of income.  While there is an established formula used by the Courts, other factors are considered such as the parenting time schedule, child care expenses, as well as any special needs of the child(ren).  Even a slight modification to your parenting time schedule can have an impact on the support amount.  Contact us for a free phone consultation.  Our capable attorneys will look at your individual circumstances, and find a better solution to your child support issues.

Alimony/Spousal Support

Alimony is not automatically awarded as is often assumed.  The Courts will consider mitigating factors in awarding or disallowing spousal support, such as, the amount of child support (if any), the parties’ incomes and earning capabilities, your spouse’s level of education, etc.  Our experienced attorneys can explain these factors in more detail, and why agreeing to “non-modifiable” spousal support is not recommended.  Call us for a free phone consultation and put our experience to work in protecting your rights.

Post Judgment Modification

Custody, child support, parenting time, and spousal support are all subject to modification.  If you have experienced a reduction in income due to a job loss, layoff, or new employment, you can and should file for a reduction in support as soon as possible.  Contact our attorneys, and we can explain the circumstances under which modifications are applicable.

Arrearages

Protect yourself from the ongoing stress of an arrearage, or worse, become the victim of child support charges.  Our attorneys can move quickly to have improperly calculated support arrearages set aside, payments plans implemented, and relieve you of this burden.

Pre-Nuptial and Post-Nuptial Agreements

Pre-nuptial and post-nuptial agreements are contractually binding and enforceable in Michigan if properly drafted.  They can protect your pre-marital property as well as the earnings, property and retirement accounts you accumulate during the marriage.  It does not have to be a 50/50 division. You can be recognized for any disparity in income and the financial contributions you make.  Proper and affordable prenuptial agreements as you approach the possibility of marriage, and similarly, sensible post-nuptial agreements, can save you considerable grief later on.
